<p>This article calmly discusses the concept of alimony and status as the head of the family in the perspective of Islamic family law, as well as its relevance to contemporary social dynamics. In fiqh, alimony is understood as a material obligation borne by the husband to meet the basic needs of the family, including food, clothing, board, health, and education according to their abilities and socio-economic conditions. This obligation is based on the husband's position as <em>a qawwām</em> or family leader, which contains the responsibility to protect, provide for and ensure the welfare of the household. This leadership status is not just a structural superiority, but a moral mandate that demands justice, compassion, and fulfillment of the rights of family members. Along with social development, the classical meaning has expanded. Increasing women's participation in work, shifting household economies, and demands for gender equality make the division of roles in the family more cooperative. Many families now rely on the economic contributions of both parties, so maintenance is not always one-way. However, the Islamic legal framework still establishes the husband as the party who bears the main maintenance obligation, while the wife's contribution is appreciated as a form of cooperation and strengthening family stability. With a normative-sociological approach, this study emphasizes that the concept of alimony and the head of the family is adaptive and can adjust the dynamics of society without eliminating the principles of justice and benefit.</p>SuhartiMasnunJumarim

<p>The development of digital technology has brought significant changes in various aspects of human life, including in the realm of family and Islamic family law. Digitalization affects the pattern of family relations, legal proof mechanisms, and administrative and judicial practices. This article aims to analyze the challenges of Islamic family law in the digital era and examine the need for regulatory adaptation to remain relevant and fair. This research uses a juridical-normative approach through literature studies by examining Islamic legal sources, laws and regulations, and the latest academic literature. The results of the study show that the digital era poses challenges in the form of changes in family relationship patterns, technology-based legal practices, and the complexity of digital proof. On the other hand, digitalization opens up opportunities to strengthen access to justice and protect the rights of women and children. Therefore, the adaptation of Islamic family law regulations based on <em>maqasid</em> <em>al-shariah</em> and social justice is an urgent need.</p>NasrullahSuaidin Naim

<p>This article focuses on studying marriage without a guardian. The type of research is library research, which is normative in nature. This article's analytical approach is qualitative. The study of the law of marriage without a guardian uses a combined method, namely the intisya'i method and the intiqa'i method. Based on the results of the analysis, the result is that marriage without a guardian actually requires a guardian to be present in the marriage, as agreed by the majority of ulama. However, based on the author's study based on facts and complaints from women, the author examines that and relying on Imam Hanafi's opinion, for certain problems according to the author, marriage without a guardian is permissible, but by prioritizing the principle of deliberation and communication first with the family, if this path cannot be taken well and actually causes other harm, then this is permissible</p>St Maryam

<p>Divorce is a legal institution that is recognized in Islam as the last resort in resolving domestic conflicts that can no longer be resolved through the mechanism of ishlah (peace). However, the massive development of digital technology in the past decade has brought significant changes to the pattern of Muslim family relations, the way of communication between husband and wife, and the mechanism of resolving domestic disputes. Digital disruption, which is characterized by social media penetration, instant communication, and digitization of legal services, also affects the dynamics of divorce from both moral, social, and legal aspects. This article aims to analyze the concept of divorce from the perspective of Islamic law and examine the challenges that arise due to digital disruption to the moral values of the family, the social structure of society, and the Islamic divorce legal system. This research uses a normative-juridical approach with qualitative analysis of Islamic legal sources, laws and regulations, and contemporary literature. The results of the study show that digital disruption poses serious challenges in the form of degradation of family communication ethics, changes in social perception of divorce, and problems of validity and proof of digital talaq. Therefore, it is necessary to strengthen contemporary fiqh, Islamic family law literacy, and harmonization between sharia principles and judicial technology innovations to maintain the benefits of Muslim families in the digital era.</p>Armansyah

<p>Penelitian ini dilatarbelakangi oleh fenomena kerentanan ekonomi yang dialami perempuan pasca-perceraian di Indonesia, di mana pemenuhan hak nafkah idah dan mut’ah seringkali hanya menjadi formalitas hukum tanpa mempertimbangkan standar kesejahteraan yang layak. Pertanyaan utama dalam studi ini adalah bagaimana rekonstruksi hukum terhadap nafkah tersebut jika dianalisis melalui perspektif ekonomi syariah untuk menjamin keberlangsungan finansial janda. Masalah ini dikaji menggunakan metode penelitian hukum normatif empiris dengan pendekatan kualitatif, yang menelaah pola pertimbangan hakim di Pengadilan Agama dalam menetapkan nominal nafkah serta efektivitas eksekusi putusan tersebut di lapangan. Analisis dilakukan dengan mengintegrasikan prinsip Maqasid al-Shari’ah (perlindungan harta) dan konsep keadilan distributif ekonomi Islam untuk mengukur sejauh mana putusan pengadilan mampu mencegah kemiskinan mendadak pada perempuan. Hasil diskusi menunjukkan bahwa praktik penetapan nafkah saat ini cenderung bersifat minimalis dan belum sepenuhnya berbasis pada prinsip financial sustainability bagi mantan istri. Oleh karena itu, penelitian ini menawarkan gagasan rekonstruksi berupa standardisasi nilai nafkah yang adaptif terhadap laju inflasi dan kemampuan ekonomi suami, serta penguatan mekanisme eksekusi otomatis melalui pemotongan penghasilan. Kesimpulan penelitian menegaskan bahwa transformasi hukum keluarga yang berorientasi pada nilai ekonomi syariah sangat krusial untuk mentransformasi peran Pengadilan Agama, tidak hanya sebagai pemutus perkara perceraian, tetapi juga sebagai instrumen perlindungan kesejahteraan ekonomi janda guna mewujudkan keadilan yang substantif dan berkelanjutan di Indonesia.</p>Suci Mulyati
